1. Purpose and Scope
These General Terms of Sale (hereinafter "Terms") govern all sales of products made through the 01mana platform between businesses (sellers) and individual users (buyers).
01mana acts solely as a payment intermediary and does not participate in the sales contract between the buyer and the seller. The sales contract is formed directly between the buyer and the selling business.
These Terms apply to all purchases made on the 01mana platform, regardless of the buyer's location, subject to applicable local laws.
2. Seller's Obligations for Product Listings
2.1 Product Information
Sellers must provide accurate, complete, and up-to-date information about their products, including:
- Detailed product description
- High-quality images and videos
- Technical specifications
- Price in USD
- Available quantities
2.2 Shipping Information
Sellers must clearly specify shipping conditions:
- Free shipping: No additional delivery costs
- Paid shipping: Fixed delivery fee
- Variable shipping: Costs depending on buyer's location
- Estimated delivery times
- Geographic coverage areas
2.3 Legal Compliance
Sellers warrant that:
- All products comply with applicable laws and regulations
- They have all necessary authorizations to sell their products
- Product information is truthful and not misleading
- They respect intellectual property rights
3. Order Process
3.1 Order Formation
An order is formed through the following steps:
- The business publishes a product with all possible details
- The buyer shows interest and adds the product to their cart
- The buyer registers their personal delivery information (auto-saved for future purchases)
- The buyer proceeds to the cart-summary page to review order summary and delivery information
- The buyer can still modify information if needed, then validates the order
- After validation, the order is created and the seller is notified with buyer information
- The seller contacts the buyer directly to arrange delivery
- Payment before or after delivery is arranged between seller and buyer, and does not concern 01mana
Important: We have tried to implement integrated payment solutions but without success at this time while the market was waiting. We have therefore decided to launch with direct seller-buyer payment arrangements while we find a suitable solution.
3.2 Order Confirmation
Upon order validation, the buyer receives:
- An order confirmation with order details
- A unique order number
- Seller contact information for delivery coordination
- Notification sent to the seller with buyer delivery information
3.3 Order Modification
Orders cannot be modified once payment is confirmed. Buyers should contact the seller directly for any special requests or modifications.
4. Pricing and Payment
4.1 Currency
The 01mana platform accepts all types of currencies. It is the seller's responsibility to specify their preferred currency when adding their product. Buyers are responsible for any currency conversion fees charged by their bank or payment provider.
4.2 Price Composition
The final price paid by the buyer includes:
- Product price set by the seller
- Shipping costs (if applicable)
- 01mana service fee (included in platform operations)
4.3 Payment Processing
- Payments are processed securely through 01mana
- Funds are held by 01mana until delivery confirmation
- Sellers receive payment only after buyer confirms receipt
- 01mana deducts its commission before transferring funds to sellers
4.4 Payment Methods
01mana supports various secure payment methods including credit cards, debit cards, and digital wallets, subject to regional availability.
5. Delivery
5.1 Delivery Responsibility
Important: 01mana does not handle shipping or delivery. All deliveries are the sole responsibility of the selling business. Buyers should coordinate directly with sellers for delivery arrangements. This is managed between the seller and the buyer, as 01mana is not yet large enough to manage delivery logistics.
5.2 Delivery Terms
- Delivery times are estimates provided by sellers
- Sellers must respect the delivery timeframes they specify
- Any delays should be communicated promptly to buyers
- Sellers are responsible for shipping costs as specified in their listings
5.3 Delivery Confirmation
To ensure secure transactions:
- A delivery confirmation code is sent to the buyer via email
- The buyer must provide this code to the delivery person
- Upon receipt, the buyer confirms delivery in their 01mana account
- Only then are funds released to the seller
5.4 Delivery Issues
In case of delivery problems:
- Buyers should first contact the seller directly
- If unresolved, buyers can contact 01mana support
- 01mana may mediate disputes between buyers and sellers
6. Right of Withdrawal
6.1 General Rule
The right of withdrawal depends on the seller's policy and applicable local laws. Buyers should inquire with the seller about their specific return policy and withdrawal periods. This right may not apply to:
- Custom-made or personalized products
- Perishable goods
- Digital products already delivered
- Sealed products that cannot be returned for hygiene reasons
6.2 Exercise of Right
To exercise the right of withdrawal:
- Contact the seller within the legal timeframe
- Return the product in its original condition
- Sellers must refund within 14 days of receiving the returned product
- Return shipping costs may apply depending on the reason
7. Warranties and Returns
7.1 Legal Warranty
Sellers must comply with legal warranty requirements in the buyer's country, including:
- Warranty of conformity (product matches description)
- Warranty against hidden defects
- Minimum warranty periods as required by law
7.2 Return Policy
Sellers may offer additional return policies beyond legal requirements. Such policies must be clearly stated in product listings.
7.3 Defective Products
- Buyers must report defects within 48 hours of receipt
- Provide photos and detailed description of the issue
- Sellers must respond within 5 business days
- Resolution may include repair, replacement, or refund
8. Commissions and Recommendations
8.1 Commission System
When a purchase is made through a recommendation:
- The recommender earns a commission set by the seller
- Commission is paid only after successful delivery confirmation
- 01mana holds commissions until delivery is verified
- Minimum payout thresholds may apply
8.2 Commission Disputes
Commission disputes are resolved by 01mana based on:
- Delivery confirmation records
- Order completion verification
- Compliance with recommendation rules
9. Liability and Disputes
9.1 01mana Liability
01mana's liability is limited to:
- Proper functioning of the payment system
- Security of transactions during the payment process
- Accurate commission calculations and payments
01mana is not liable for product quality, delivery delays, or disputes between buyers and sellers.
9.2 Seller Liability
- Sellers are fully responsible for products they sell
- Sellers must honor all warranties and return policies
- Sellers are liable for delivery and shipping arrangements
9.3 Dispute Resolution
- First step: Direct negotiation between buyer and seller
- Second step: 01mana mediation within 30 days
- Final step: Legal proceedings in competent courts
10. Applicable Law and Jurisdiction
These Terms are governed by the laws of the buyer's country of residence. Any disputes shall first be resolved through 01mana mediation, then through the competent courts of the buyer's jurisdiction.
For international buyers, disputes will be resolved according to the United Nations Convention on Contracts for the International Sale of Goods (CISG) where applicable.
